Florida Owner Finance Advertising Rules
Florida Owner Finance's advertising rules has a very basic purpose - provide a safe, reliable, comfortable place for buyers to search for property and the first thing to do is not tolerate any deception or fraudulent statements. This is good for all parties.
Florida Property Owner Advertising Rules
1. In each category of the property or item listing section, you can have ONLY list property or item listings that are for sale that are a fit in the category you placed the listing. You cannot list any services at all or any products that do not belong.
NOTE: By submitting an ad under the above described section, that does not belong, you are agreeing to pay $50 per day, that the ad runs, plus any and all collection fees. If you have a service or product to sell, that doesn't fit in the property or Item listing section, we have a business section that you can advertise such items in for as little as $9.95 per month.
2. Proper Disclosure of property, owner terms, down payment, and your finance method. You cannot state that it is OWNER FINANCE unless it is a TRUE owner finance. Owner Finance is defined as: A Contract for Deed or an actual Deed of Trust is provided at closing. (Most States regulate Owner Finance sales now and it is best you contact a real estate attorney to specify how you can sell your property owner finance.) PLEASE PLACE you ad in the proper category(s). Up to 3 categories allowed. Must BE relevant to category.
3. Rent to Own, Lease to Own, Rent to purchase, Lease Purchase, Lease with Option to Purchase are viable options and or choices for real estate but they are NOT considered to be Owner Finance.
4. Real Estate Professional Disclosure: Most states require that real estate professionals (at least broker and or agents) disclose, in any and all advertising, that they are a real estate professional. This is so the public knows that are dealing with an expert. We also require disclosure of all real estate professionals including but not limited to: Agents, Appraisers, Attorneys, Brokers, Home Inspectors, administrative staff for any one of these listed groups. When placing your listing, there is a Drop Down box for you to chose from, that is a list of seller / owner categories. Please choose the one that best describes you.
VIOLATION of the Florida advertising rules will result in your FREE listing membership being canceled along with all properties.
